The Precepts of Wisdom in Surah al-Isra


لَّا تَجْعَلْ مَعَ اللَّهِ إِلَٰهًا آخَرَ فَتَقْعُدَ مَذْمُومًا مَّخْذُولًا
 
#1 Q17:22 Take not with God another object of worship; or thou (O man!) wilt sit in disgrace and destitution.

وَقَضَىٰ رَبُّكَ أَلَّا تَعْبُدُوا إِلَّا إِيَّاهُ وَبِالْوَالِدَيْنِ إِحْسَانًا إِمَّا يَبْلُغَنَّ عِندَكَ الْكِبَرَ أَحَدُهُمَا أَوْ كِلَاهُمَا فَلَا تَقُل لَّهُمَا أُفٍّ وَلَا تَنْهَرْهُمَا وَقُل لَّهُمَا قَوْلًا كَرِيمًا
وَاخْفِضْ لَهُمَا جَنَاحَ الذُّلِّ مِنَ الرَّحْمَةِ وَقُل رَّبِّ ارْحَمْهُمَا كَمَا رَبَّيَانِي صَغِيرًا
رَّبُّكُمْ أَعْلَمُ بِمَا فِي نُفُوسِكُمْ إِن تَكُونُوا صَالِحِينَ فَإِنَّهُ كَانَ لِلْأَوَّابِينَ غَفُورًا

#2 Q17:23-25 Thy Lord hath decreed that ye worship none but Him, and that ye be kind to parents. Whether one or both of them attain old age in thy life, say not to them a word of contempt, nor repel them, but address them in terms of honour. And, out of kindness, lower to them the wing of humility, and say: "My Lord! bestow on them thy Mercy even as they cherished me in childhood.” Your Lord knoweth best what is in your hearts: If ye do deeds of righteousness, verily He is Most Forgiving to those who turn to Him again and again (in true penitence).

وَآتِ ذَا الْقُرْبَىٰ حَقَّهُ وَالْمِسْكِينَ وَابْنَ السَّبِيلِ وَلَا تُبَذِّرْ تَبْذِيرًا
إِنَّ الْمُبَذِّرِينَ كَانُوا إِخْوَانَ الشَّيَاطِينِ وَكَانَ الشَّيْطَانُ لِرَبِّهِ كَفُورًا
وَإِمَّا تُعْرِضَنَّ عَنْهُمُ ابْتِغَاءَ رَحْمَةٍ مِّن رَّبِّكَ تَرْجُوهَا فَقُل لَّهُمْ قَوْلًا مَّيْسُورًا
وَلَا تَجْعَلْ يَدَكَ مَغْلُولَةً إِلَىٰ عُنُقِكَ وَلَا تَبْسُطْهَا كُلَّ الْبَسْطِ فَتَقْعُدَ مَلُومًا مَّحْسُورًا
إِنَّ رَبَّكَ يَبْسُطُ الرِّزْقَ لِمَن يَشَاءُ وَيَقْدِرُ إِنَّهُ كَانَ بِعِبَادِهِ خَبِيرًا بَصِيرًا

#3 Q17:26-30 And render to the kindred their due rights, as (also) to those in want, and to the wayfarer: But squander not (your wealth) in the manner of a spendthrift. Verily spendthrifts are brothers of the Evil Ones; and the Evil One is to his Lord (himself) ungrateful. And even if thou hast to turn away from them in pursuit of the Mercy from thy Lord which thou dost expect, yet speak to them a word of easy kindness. Make not thy hand tied (like a niggard's) to thy neck, nor stretch it forth to its utmost reach, so that thou become blameworthy and destitute. Verily thy Lord doth provide sustenance in abundance for whom He pleaseth, and He provideth in a just measure. For He doth know and regard all His servants. 

وَلَا تَقْتُلُوا أَوْلَادَكُمْ خَشْيَةَ إِمْلَاقٍ نَّحْنُ نَرْزُقُهُمْ وَإِيَّاكُمْ إِنَّ قَتْلَهُمْ كَانَ خِطْئًا كَبِيرًا

#4 Q17:31 Kill not your children for fear of want: We shall provide sustenance for them as well as for you. Verily the killing of them is a great sin.

وَلَا تَقْرَبُوا الزِّنَا إِنَّهُ كَانَ فَاحِشَةً وَسَاءَ سَبِيلًا

#5 Q17:32 Nor come nigh to adultery: for it is a shameful (deed) and an evil, opening the road (to other evils).

وَلَا تَقْتُلُوا النَّفْسَ الَّتِي حَرَّمَ اللَّهُ إِلَّا بِالْحَقِّ وَمَن قُتِلَ مَظْلُومًا فَقَدْ جَعَلْنَا لِوَلِيِّهِ سُلْطَانًا فَلَا يُسْرِف فِّي الْقَتْلِ إِنَّهُ كَانَ مَنصُورًا

#6 Q17:33 Nor take life - which God has made sacred - except for just cause. And if anyone is slain wrongfully, we have given his heir authority (to demand qisas or to forgive): but let him nor exceed bounds in the matter of taking life; for he is helped (by the Law). 

وَلَا تَقْرَبُوا مَالَ الْيَتِيمِ إِلَّا بِالَّتِي هِيَ أَحْسَنُ حَتَّىٰ يَبْلُغَ أَشُدَّهُ وَأَوْفُوا بِالْعَهْدِ إِنَّ الْعَهْدَ كَانَ مَسْئُولًا

#7 Q17:34 Come not nigh to the orphan's property except to improve it, until he attains the age of full strength; #8 and fulfil (every) engagement, for (every) engagement will be enquired into (on the Day of Reckoning).

وَأَوْفُوا الْكَيْلَ إِذَا كِلْتُمْ وَزِنُوا بِالْقِسْطَاسِ الْمُسْتَقِيمِ ذَٰلِكَ خَيْرٌ وَأَحْسَنُ تَأْوِيلًا

#9 Q17:35 Give full measure when ye measure, and weigh with a balance that is straight: that is the most fitting and the most advantageous in the final determination. 

وَلَا تَقْفُ مَا لَيْسَ لَكَ بِهِ عِلْمٌ إِنَّ السَّمْعَ وَالْبَصَرَ وَالْفُؤَادَ كُلُّ أُولَٰئِكَ كَانَ عَنْهُ مَسْئُولًا

#10 Q17:36 And pursue not that of which thou hast no knowledge; for every act of hearing, or of seeing or of (feeling in) the heart will be enquired into (on the Day of Reckoning). 

وَلَا تَمْشِ فِي الْأَرْضِ مَرَحًا إِنَّكَ لَن تَخْرِقَ الْأَرْضَ وَلَن تَبْلُغَ الْجِبَالَ طُولًا

كُلُّ ذَٰلِكَ كَانَ سَيِّئُهُ عِندَ رَبِّكَ مَكْرُوهًا

#11 Q17:37-38 Nor walk on the earth with insolence: for thou canst not rend the earth asunder, nor reach the mountains in height. Of all such things the evil is hateful in the sight of thy Lord.

ذَٰلِكَ مِمَّا أَوْحَىٰ إِلَيْكَ رَبُّكَ مِنَ الْحِكْمَةِ وَلَا تَجْعَلْ مَعَ اللَّهِ إِلَٰهًا آخَرَ فَتُلْقَىٰ فِي جَهَنَّمَ مَلُومًا مَّدْحُورًا

Q17:39 These are among the (precepts of) wisdom, which thy Lord has revealed to thee. Take not, with God, another object of worship, lest thou shouldst be thrown into Hell, blameworthy and rejected.

Homosexuality, Adultery and Rape

The Quran is explained in detail, and provides guidance on all matters in which we may not be able to legislate appropriately on our own. Sexual orientations, and the sins and crimes associated with it fall under such a category where we get confused and have varied opinions.

Efforts to purify the NAFS is the object of this temporal life; as the womb is central to procreation, guarding it is of great importance.


Homosexuality 

وَاللَّاتِي يَأْتِينَ الْفَاحِشَةَ مِن نِّسَائِكُمْ فَاسْتَشْهِدُوا عَلَيْهِنَّ أَرْبَعَةً مِّنكُمْ فَإِن شَهِدُوا فَأَمْسِكُوهُنَّ فِي الْبُيُوتِ حَتَّىٰ يَتَوَفَّاهُنَّ الْمَوْتُ أَوْ يَجْعَلَ اللَّهُ لَهُنَّ سَبِيلًا
وَاللَّذَانِ يَأْتِيَانِهَا مِنكُمْ فَآذُوهُمَا فَإِن تَابَا وَأَصْلَحَا فَأَعْرِضُوا عَنْهُمَا إِنَّ اللَّهَ كَانَ تَوَّابًا رَّحِيمًا
إِنَّمَا التَّوْبَةُ عَلَى اللَّهِ لِلَّذِينَ يَعْمَلُونَ السُّوءَ بِجَهَالَةٍ ثُمَّ يَتُوبُونَ مِن قَرِيبٍ فَأُولَٰئِكَ يَتُوبُ اللَّهُ عَلَيْهِمْ وَكَانَ اللَّهُ عَلِيمًا حَكِيمًا
وَلَيْسَتِ التَّوْبَةُ لِلَّذِينَ يَعْمَلُونَ السَّيِّئَاتِ حَتَّىٰ إِذَا حَضَرَ أَحَدَهُمُ الْمَوْتُ قَالَ إِنِّي تُبْتُ الْآنَ وَلَا الَّذِينَ يَمُوتُونَ وَهُمْ كُفَّارٌ أُولَٰئِكَ أَعْتَدْنَا لَهُمْ عَذَابًا أَلِيمًا

If any of your women are guilty of lewdness, Take the evidence of four (Reliable) witnesses from amongst you against them; and if they testify, confine them to houses until death do claim them, or God ordain for them some (other) way. 
If two men among you are guilty of lewdness, punish them both. If they repent and amend, Leave them alone; for God is Oft-returning, Most Merciful. 
God accept the repentance of those who do evil in ignorance and repent soon afterwards; to them will God turn in mercy: For God is full of knowledge and wisdom.
Of no effect is the repentance of those who continue to do evil, until death faces one of them, and he says, "Now have I repented indeed;" nor of those who die rejecting Faith: for them have We prepared a punishment most grievous.

Adultery 

سُورَةٌ أَنزَلْنَاهَا وَفَرَضْنَاهَا وَأَنزَلْنَا فِيهَا آيَاتٍ بَيِّنَاتٍ لَّعَلَّكُمْ تَذَكَّرُونَ
الزَّانِيَةُ وَالزَّانِي فَاجْلِدُوا كُلَّ وَاحِدٍ مِّنْهُمَا مِائَةَ جَلْدَةٍ وَلَا تَأْخُذْكُم بِهِمَا رَأْفَةٌ فِي دِينِ اللَّهِ إِن كُنتُمْ تُؤْمِنُونَ بِاللَّهِ وَالْيَوْمِ الْآخِرِ وَلْيَشْهَدْ عَذَابَهُمَا طَائِفَةٌ مِّنَ الْمُؤْمِنِينَ
الزَّانِي لَا يَنكِحُ إِلَّا زَانِيَةً أَوْ مُشْرِكَةً وَالزَّانِيَةُ لَا يَنكِحُهَا إِلَّا زَانٍ أَوْ مُشْرِكٌ وَحُرِّمَ ذَٰلِكَ عَلَى الْمُؤْمِنِينَ
وَالَّذِينَ يَرْمُونَ الْمُحْصَنَاتِ ثُمَّ لَمْ يَأْتُوا بِأَرْبَعَةِ شُهَدَاءَ فَاجْلِدُوهُمْ ثَمَانِينَ جَلْدَةً وَلَا تَقْبَلُوا لَهُمْ شَهَادَةً أَبَدًا وَأُولَٰئِكَ هُمُ الْفَاسِقُونَ
إِلَّا الَّذِينَ تَابُوا مِن بَعْدِ ذَٰلِكَ وَأَصْلَحُوا فَإِنَّ اللَّهَ غَفُورٌ رَّحِيمٌ
وَالَّذِينَ يَرْمُونَ أَزْوَاجَهُمْ وَلَمْ يَكُن لَّهُمْ شُهَدَاءُ إِلَّا أَنفُسُهُمْ فَشَهَادَةُ أَحَدِهِمْ أَرْبَعُ شَهَادَاتٍ بِاللَّهِ إِنَّهُ لَمِنَ الصَّادِقِينَ
وَالْخَامِسَةُ أَنَّ لَعْنَتَ اللَّهِ عَلَيْهِ إِن كَانَ مِنَ الْكَاذِبِينَ
وَيَدْرَأُ عَنْهَا الْعَذَابَ أَن تَشْهَدَ أَرْبَعَ شَهَادَاتٍ بِاللَّهِ إِنَّهُ لَمِنَ الْكَاذِبِينَ
وَالْخَامِسَةَ أَنَّ غَضَبَ اللَّهِ عَلَيْهَا إِن كَانَ مِنَ الصَّادِقِينَ
وَلَوْلَا فَضْلُ اللَّهِ عَلَيْكُمْ وَرَحْمَتُهُ وَأَنَّ اللَّهَ تَوَّابٌ حَكِيمٌ
إِنَّ الَّذِينَ جَاءُوا بِالْإِفْكِ عُصْبَةٌ مِّنكُمْ لَا تَحْسَبُوهُ شَرًّا لَّكُم بَلْ هُوَ خَيْرٌ لَّكُمْ لِكُلِّ امْرِئٍ مِّنْهُم مَّا اكْتَسَبَ مِنَ الْإِثْمِ وَالَّذِي تَوَلَّىٰ كِبْرَهُ مِنْهُمْ لَهُ عَذَابٌ عَظِيمٌ
لَّوْلَا إِذْ سَمِعْتُمُوهُ ظَنَّ الْمُؤْمِنُونَ وَالْمُؤْمِنَاتُ بِأَنفُسِهِمْ خَيْرًا وَقَالُوا هَٰذَا إِفْكٌ مُّبِينٌ
لَّوْلَا جَاءُوا عَلَيْهِ بِأَرْبَعَةِ شُهَدَاءَ فَإِذْ لَمْ يَأْتُوا بِالشُّهَدَاءِ فَأُولَٰئِكَ عِندَ اللَّهِ هُمُ الْكَاذِبُونَ
وَلَوْلَا فَضْلُ اللَّهِ عَلَيْكُمْ وَرَحْمَتُهُ فِي الدُّنْيَا وَالْآخِرَةِ لَمَسَّكُمْ فِي مَا أَفَضْتُمْ فِيهِ عَذَابٌ عَظِيمٌ
إِذْ تَلَقَّوْنَهُ بِأَلْسِنَتِكُمْ وَتَقُولُونَ بِأَفْوَاهِكُم مَّا لَيْسَ لَكُم بِهِ عِلْمٌ وَتَحْسَبُونَهُ هَيِّنًا وَهُوَ عِندَ اللَّهِ عَظِيمٌ
وَلَوْلَا إِذْ سَمِعْتُمُوهُ قُلْتُم مَّا يَكُونُ لَنَا أَن نَّتَكَلَّمَ بِهَٰذَا سُبْحَانَكَ هَٰذَا بُهْتَانٌ عَظِيمٌ
يَعِظُكُمُ اللَّهُ أَن تَعُودُوا لِمِثْلِهِ أَبَدًا إِن كُنتُم مُّؤْمِنِينَ
وَيُبَيِّنُ اللَّهُ لَكُمُ الْآيَاتِ وَاللَّهُ عَلِيمٌ حَكِيمٌ
إِنَّ الَّذِينَ يُحِبُّونَ أَن تَشِيعَ الْفَاحِشَةُ فِي الَّذِينَ آمَنُوا لَهُمْ عَذَابٌ أَلِيمٌ فِي الدُّنْيَا وَالْآخِرَةِ وَاللَّهُ يَعْلَمُ وَأَنتُمْ لَا تَعْلَمُونَ
وَلَوْلَا فَضْلُ اللَّهِ عَلَيْكُمْ وَرَحْمَتُهُ وَأَنَّ اللَّهَ رَءُوفٌ رَّحِيمٌ
يَا أَيُّهَا الَّذِينَ آمَنُوا لَا تَتَّبِعُوا خُطُوَاتِ الشَّيْطَانِ وَمَن يَتَّبِعْ خُطُوَاتِ الشَّيْطَانِ فَإِنَّهُ يَأْمُرُ بِالْفَحْشَاءِ وَالْمُنكَرِ وَلَوْلَا فَضْلُ اللَّهِ عَلَيْكُمْ وَرَحْمَتُهُ مَا زَكَىٰ مِنكُم مِّنْ أَحَدٍ أَبَدًا وَلَٰكِنَّ اللَّهَ يُزَكِّي مَن يَشَاءُ وَاللَّهُ سَمِيعٌ عَلِيمٌ
وَلَا يَأْتَلِ أُولُو الْفَضْلِ مِنكُمْ وَالسَّعَةِ أَن يُؤْتُوا أُولِي الْقُرْبَىٰ وَالْمَسَاكِينَ وَالْمُهَاجِرِينَ فِي سَبِيلِ اللَّهِ وَلْيَعْفُوا وَلْيَصْفَحُوا أَلَا تُحِبُّونَ أَن يَغْفِرَ اللَّهُ لَكُمْ وَاللَّهُ غَفُورٌ رَّحِيمٌ
إِنَّ الَّذِينَ يَرْمُونَ الْمُحْصَنَاتِ الْغَافِلَاتِ الْمُؤْمِنَاتِ لُعِنُوا فِي الدُّنْيَا وَالْآخِرَةِ وَلَهُمْ عَذَابٌ عَظِيمٌ
يَوْمَ تَشْهَدُ عَلَيْهِمْ أَلْسِنَتُهُمْ وَأَيْدِيهِمْ وَأَرْجُلُهُم بِمَا كَانُوا يَعْمَلُونَ
يَوْمَئِذٍ يُوَفِّيهِمُ اللَّهُ دِينَهُمُ الْحَقَّ وَيَعْلَمُونَ أَنَّ اللَّهَ هُوَ الْحَقُّ الْمُبِينُ
الْخَبِيثَاتُ لِلْخَبِيثِينَ وَالْخَبِيثُونَ لِلْخَبِيثَاتِ وَالطَّيِّبَاتُ لِلطَّيِّبِينَ وَالطَّيِّبُونَ لِلطَّيِّبَاتِ أُولَٰئِكَ مُبَرَّءُونَ مِمَّا يَقُولُونَ لَهُم مَّغْفِرَةٌ وَرِزْقٌ كَرِيمٌ

A sura which We have sent down and which We have ordained in it have We sent down Clear Signs, in order that ye may receive admonition.
The woman and the man guilty of adultery or fornication,- flog each of them with a hundred stripes: Let not compassion move you in their case, in a matter prescribed by God, if ye believe in God and the Last Day: and let a party of the Believers witness their punishment.
Let no man guilty of adultery or fornication marry and but a woman similarly guilty, or an Unbeliever: nor let any but such a man or an Unbeliever marry such a woman: to the Believers such a thing is forbidden.
And those who launch a charge against chaste women, and produce not four witnesses (to support their allegations),- flog them with eighty stripes; and reject their evidence ever after: for such men are wicked transgressors;-
Unless they repent thereafter and mend (their conduct); for God is Oft- Forgiving, Most Merciful.
And for those who launch a charge against their spouses, and have (in support) no evidence but their own,- their solitary evidence (can be received) if they bear witness four times (with an oath) by God that they are solemnly telling the truth;
And the fifth (oath) (should be) that they solemnly invoke the curse of God on themselves if they tell a lie.
But it would avert the punishment from the wife, if she bears witness four times (with an oath) By God, that (her husband) is telling a lie;
And the fifth (oath) should be that she solemnly invokes the wrath of God on herself if (her accuser) is telling the truth.
If it were not for God's grace and mercy on you, and that God is Oft- Returning, full of Wisdom,- (Ye would be ruined indeed).
Those who brought forward the lie are a body among yourselves: think it not to be an evil to you; On the contrary it is good for you: to every man among them (will come the punishment) of the sin that he earned, and to him who took on himself the lead among them, will be a penalty grievous.
Why did not the believers - men and women - when ye heard of the affair,- put the best construction on it in their own minds and say, "This (charge) is an obvious lie" ?
Why did they not bring four witnesses to prove it? When they have not brought the witnesses, such men, in the sight of God, (stand forth) themselves as liars!
Were it not for the grace and mercy of God on you, in this world and the Hereafter, a grievous penalty would have seized you in that ye rushed glibly into this affair.
Behold, ye received it on your tongues, and said out of your mouths things of which ye had no knowledge; and ye thought it to be a light matter, while it was most serious in the sight of God.
And why did ye not, when ye heard it, say? - "It is not right of us to speak of this: Glory to God! this is a most serious slander!"
God doth admonish you, that ye may never repeat such (conduct), if ye are (true) Believers.
And God makes the Signs plain to you: for God is full of knowledge and wisdom.
Those who love (to see) scandal published broadcast among the Believers, will have a grievous Penalty in this life and in the Hereafter: God knows, and ye know not.
Were it not for the grace and mercy of God on you, and that God is full of kindness and mercy, (ye would be ruined indeed).
O ye who believe! follow not Satan's footsteps: if any will follow the footsteps of Satan, he will (but) command what is shameful and wrong: and were it not for the grace and mercy of God on you, not one of you would ever have been pure: but God doth purify whom He pleases: and God is One Who hears and knows (all things).
Let not those among you who are endued with grace and amplitude of means resolve by oath against helping their kinsmen, those in want, and those who have left their homes in God's cause: let them forgive and overlook, do you not wish that God should forgive you? For God is Oft-Forgiving, Most Merciful.
Those who slander chaste women, indiscreet but believing, are cursed in this life and in the Hereafter: for them is a grievous Penalty,-
On the Day when their tongues, their hands, and their feet will bear witness against them as to their actions.
On that Day God will pay them back (all) their just dues, and they will realise that God is the (very) Truth, that makes all things manifest.
Women impure are for men impure, and men impure for women impure and women of purity are for men of purity, and men of purity are for women of purity: these are not affected by what people say: for them there is forgiveness, and a provision honourable.

Rape 

إِنَّ الَّذِينَ يُؤْذُونَ اللَّهَ وَرَسُولَهُ لَعَنَهُمُ اللَّهُ فِي الدُّنْيَا وَالْآخِرَةِ وَأَعَدَّ لَهُمْ عَذَابًا مُّهِينًا
وَالَّذِينَ يُؤْذُونَ الْمُؤْمِنِينَ وَالْمُؤْمِنَاتِ بِغَيْرِ مَا اكْتَسَبُوا فَقَدِ احْتَمَلُوا بُهْتَانًا وَإِثْمًا مُّبِينًا
يَا أَيُّهَا النَّبِيُّ قُل لِّأَزْوَاجِكَ وَبَنَاتِكَ وَنِسَاءِ الْمُؤْمِنِينَ يُدْنِينَ عَلَيْهِنَّ مِن جَلَابِيبِهِنَّ ذَٰلِكَ أَدْنَىٰ أَن يُعْرَفْنَ فَلَا يُؤْذَيْنَ وَكَانَ اللَّهُ غَفُورًا رَّحِيمًا
لَّئِن لَّمْ يَنتَهِ الْمُنَافِقُونَ وَالَّذِينَ فِي قُلُوبِهِم مَّرَضٌ وَالْمُرْجِفُونَ فِي الْمَدِينَةِ لَنُغْرِيَنَّكَ بِهِمْ ثُمَّ لَا يُجَاوِرُونَكَ فِيهَا إِلَّا قَلِيلًا
مَّلْعُونِينَ أَيْنَمَا ثُقِفُوا أُخِذُوا وَقُتِّلُوا تَقْتِيلًا
سُنَّةَ اللَّهِ فِي الَّذِينَ خَلَوْا مِن قَبْلُ وَلَن تَجِدَ لِسُنَّةِ اللَّهِ تَبْدِيلًا

Those who annoy God and His Apostle - God has cursed them in this World and in the Hereafter, and has prepared for them a humiliating Punishment.
And those who annoy believing men and women undeservedly, bear (on themselves) a calumny and a glaring sin.
O Prophet! Tell thy wives and daughters, and the believing women, that they should cast their outer garments over their persons (when abroad): that is most convenient, that they should be known (as such) and not molested. And God is Oft- Forgiving, Most Merciful.
Truly, if the Hypocrites, and those in whose hearts is a disease, and those who stir up sedition in the City, desist not, We shall certainly stir thee up against them: Then will they not be able to stay in it as thy neighbours for any length of time:
They shall have a curse on them: whenever they are found, they shall be seized and slain (without mercy).
(Such was) the practice (approved) of God among those who lived aforetime: No change wilt thou find in the practice (approved) of God.

From the above ayaat, it seems clear that rape, and all other such offences, in which the woman's consent is not present, should be considered as crimes against them, and prosecuted as such.

Is Temporary Marriage the Halal Alternate to Dating?

My Comments: 
According to Q24:3 ‘The adulterer shall not marry save an adulteress or an idolatress, and the adulteress none shall marry save an adulterer or an idolater. All that is forbidden unto believers.’ How can a believer marry a call girl, even temporarily, when he knows that she does this as a profession, and therefore is probably an adulteress? 
Q4:35 and Q65:1-12 list the legal requirements for divorce. Two arbiters, one from each spouse’s family must represent them, a fixed period (number of months) is mandatory before the divorce takes effect, and the wife stays in the husband’s home during that fixed period. How are the legal conditions for divorce satisfied in the case of ‘temporary marriage’ when the prescribed wait period for women before remarriage cannot be observed as the business needs dictate that temporary marriages are contracted frequently? 

Quran is the primary text of Islam. Muslims are duty-bound to take guidance directly from the Quran, and to refer to other secondary sources, such as prior scriptures, hadith books, historical precedents or ijtihad only when the Quran does not contain guidance on a particular matter. Q4:21 describes nikah as a strong pledge between the spouses. Temporary Marriage (Nikah Mutah) seems contrary to the letter and spirit of a number of Quranic ayaat dealing with Marriage, Divorce, Adultery, Morality, Decency & Social Conduct. Q4:24 states that union should be sought desiring chastity, not unlawful sexual intercourse. Q7:27 warns us that Satan’s objective was to strip Adam & Eve of their clothing which led to their expulsion from the garden. Q7:28 states that people try to justify their immorality by saying that God ordered it, and clearly clarifies that God does not order   ‘fahishatan’ (immorality / indecency / lewdness). Q24:30-32 orders the guarding of gaze to both men and women, and prohibits women from displaying their beauty. Special mention is made of AAawrati alnnisa-i (women’s private aspects / nakedness). Those men who use dating services, how do they guard their gaze from women’s nakedness when they are looking at published photos to choose from? Those women who advertise their services, including photographs of the body, how do they comply with the injunction to hide their nakedness from potential clients who are obviously not yet their mahram?

Morality 
Nakedness is an object of Satan’s seduction of humans. According to the literal interpretation of the Q7:27, Satan’s purpose to seduce Adam into eating the forbidden fruit was to get them naked and make their shame manifest to them. It is important to note here that Adam and his wife were each other’s spouse. Furthermore, using God / Scripture as an excuse to do immoral acts is nothing new.

[Quran 7:27, Translation: Literal (Word by Word)] O Children (of) Adam! (Let) not tempt you [the] Shaitaan as he drove out your parents from Paradise, stripping from both of them their clothing to show both of them their shame. Indeed, he sees you - he and his tribe from where not you see them. Indeed, We have made the devils friends of those who (do) not believe. 
And the following ayat links it to ‘fahishatan’ (immorality / indecency / lewdness): 
[Quran 7:28, Translation: Literal (Word by Word)] And when they do immorality they say, "We found on it our forefathers and Allah (has) ordered us of it." Say, "Indeed, Allah (does) not order immorality. Do you say about Allah what you (do) not know?” 
After refuting their assertion, the next ayat goes on to not only state that God orders justice, but  I think it also links it back to 7:27 by linking origin (bani Adam) to return (resurrection): 
[Quran 7:29, Translation: Literal (Word by Word)] Say, "My Lord has ordered justice and set your faces at every masjid and invoke Him (being) sincere to Him (in) the religion. As He originated you (so) will you return.” 

The injunction for justice is also present in the conditional permission for polygamy given to marry orphan’s women (widowed mothers) in 4:3 and 4:127 in case the men are unable to take care of orphans otherwise. (Polygamy: http://islam-qna.blogspot.com/2010/09/polygamy.html)


Decency & Social Conduct between Men & Women 
Since both men and women are enjoined to guard their gaze, how can the men who use dating services guard their gaze from women’s nakedness when they are looking at published photos to choose from? Those women who advertise their services, including photographs of the body, how do they comply with the injunction to hide their nakedness from potential clients who are obviously not yet their mahram?
[Quran 19:30-32, Translator:Pickthall] Tell the believing men to lower their gaze and be modest. That is purer for them. Lo! Allah is aware of what they do. And tell the believing women to lower their gaze and be modest, and to display of their adornment only that which is apparent, and to draw their veils over their bosoms, and not to reveal their adornment save to their own husbands or fathers or husbands' fathers, or their sons or their husbands' sons, or their brothers or their brothers' sons or sisters' sons, or their women, or their slaves, or male attendants who lack vigour, or children who know naught of women's nakedness. And let them not stamp their feet so as to reveal what they hide of their adornment. And turn unto Allah together, O believers, in order that ye may succeed. And marry such of you as are solitary and the pious of your slaves and maid-servants. If they be poor, Allah will enrich them of His bounty. Allah is of ample means, Aware.


Desires & Lusts 
[Quran 19:58-60, Translator:Pickthall] These are they unto whom Allah showed favour from among the prophets, of the seed of Adam and of those whom We carried (in the ship) with Noah, and of the seed of Abraham and Israel, and from among those whom We guided and chose. When the revelations of the Beneficent were recited unto them, they fell down, adoring and weeping. Now there hath succeeded them a later generation whom have ruined worship and have followed lusts. But they will meet deception. Except those who repent, believe and do righteousness; for those will enter Paradise and will not be wronged at all. 

The word used in 19:59:11 is ‘ghayyan’ variously translated as evil / deception / disillusionment as the result of following 19:59:8 ‘alshshahawati’ translated as lusts / passions / sensual desires…  


Marriage 
Consider the following ayaat regarding marriage, who can Muslims marry, solemn pledge between the spouses, conditional polygamy, etc: 

[Quran 24:3, Translator:Pickthall] 
3 The adulterer shall not marry save an adulteress or an idolatress, and the adulteress none shall marry save an adulterer or an idolater. All that is forbidden unto believers. 

[Quran 4:2-6, Translator:Pickthall] 
2 Give unto orphans their wealth. Exchange not the good for the bad (in your management thereof) nor absorb their wealth into your own wealth. Lo! that would be a great sin.
3 And if ye fear that ye will not deal fairly by the orphans, marry of the women, who seem good to you, two or three or four; and if ye fear that ye cannot do justice (to so many) then one (only) or (the captives) that your right hands possess. Thus it is more likely that ye will not do injustice.  
4 And give unto the women (whom ye marry) free gift of their marriage portions; but if they of their own accord remit unto you a part thereof, then ye are welcome to absorb it (in your wealth).  
5 Give not unto the foolish (what is in) your (keeping of their) wealth, which Allah hath given you to maintain; but feed and clothe them from it, and speak kindly unto them.  
6 Prove orphans till they reach the marriageable age; then, if ye find them of sound judgment, deliver over unto them their fortune; and devour it not by squandering and in haste lest they should grow up Whoso (of the guardians) is rich, let him abstain generously (from taking of the property of orphans); and whoso is poor let him take thereof in reason (for his guardianship). And when ye deliver up their fortune unto orphans, have (the transaction) witnessed in their presence. Allah sufficeth as a Reckoner. 


[Quran 4:19-28, Translator:Pickthall] 
19 O ye who believe! It is not lawful for you forcibly to inherit the women (of your deceased kinsmen), nor (that) ye should put constraint upon them that ye may take away a part of that which ye have given them, unless they be guilty of flagrant lewdness. But consort with them in kindness, for if ye hate them it may happen that ye hate a thing wherein Allah hath placed much good.
20 And if ye wish to exchange one wife for another and ye have given unto one of them a sum of money (however great), take nothing from it. Would ye take it by the way of calumny and open wrong?
21 How can ye take it (back) after one of you hath gone in unto the other, and they have taken a strong pledge from you?
22 And marry not those women whom your fathers married, except what hath already happened (of that nature) in the past. Lo! it was ever lewdness and abomination, and an evil way. 
23 Forbidden unto you are your mothers, and your daughters, and your sisters, and your father's sisters, and your mother's sisters, and your brother's daughters and your sister's daughters, and your foster-mothers, and your foster-sisters, and your mothers-in-law, and your step-daughters who are under your protection (born) of your women unto whom ye have gone in - but if ye have not gone in unto them, then it is no sin for you (to marry their daughters) - and the wives of your sons who (spring) from your own loins. And (it is forbidden unto you) that ye should have two sisters together, except what hath already happened (of that nature) in the past. Lo! Allah is ever Forgiving, Merciful.  
24 And all married women (are forbidden unto you) save those (captives) whom your right hands possess. It is a decree of Allah for you. Lawful unto you are all beyond those mentioned, so that ye seek them with your wealth in honest wedlock, not debauchery. And those of whom ye seek content (by marrying them), give unto them their portions as a duty. And there is no sin for you in what ye do by mutual agreement after the duty (hath been done). Lo! Allah is ever Knower, Wise. 
25 And whoso is not able to afford to marry free, believing women, let them marry from the believing maids whom your right hands possess. Allah knoweth best (concerning) your faith. Ye (proceed) one from another; so wed them by permission of their folk, and give unto them their portions in kindness, they being honest, not debauched nor of loose conduct. And if when they are honourably married they commit lewdness they shall incur the half of the punishment (prescribed) for free women (in that case). This is for him among you who feareth to commit sin. But to have patience would be better for you. Allah is Forgiving, Merciful.
26 Allah would explain to you and guide you by the examples of those who were before you, and would turn to you in mercy. Allah is Knower, Wise.  
27 And Allah would turn to you in mercy; but those who follow vain desires would have you go tremendously astray.
28 Allah would make the burden light for you, for man was created weak.

[Quran 4:34, Translator:Pickthall]
34 Men are in charge of women, because Allah hath made the one of them to excel the other, and because they spend of their property (for the support of women). So good women are the obedient, guarding in secret that which Allah hath guarded. As for those from whom ye fear rebellion, admonish them and banish them to beds apart, and scourge them. Then if they obey you, seek not a way against them. Lo! Allah is ever High, Exalted, Great.  


[Quran 4:127, Translator:Pickthall] 
127 They consult thee concerning women. Say: Allah giveth you decree concerning them, and the Scripture which hath been recited unto you (giveth decree), concerning female orphans and those unto whom ye give not that which is ordained for them though ye desire to marry them, and (concerning) the weak among children, and that ye should deal justly with orphans. Whatever good ye do, lo! Allah is ever Aware of it. 

[Quran 5:5, Translator:Pickthall]
5 This day are (all) good things made lawful for you. The food of those who have received the Scripture is lawful for you, and your food is lawful for them. And so are the virtuous women of the believers and the virtuous women of those who received the Scripture before you (lawful for you) when ye give them their marriage portions and live with them in honour, not in fornication, nor taking them as secret concubines. Whoso denieth the faith, his work is vain and he will be among the losers in the Hereafter. 

[Quran 30:21, Translator: Sahih International] 
And of His signs is that He created for you from yourselves mates that you may find tranquillity in them; and He placed between you affection and mercy. Indeed in that are signs for a people who give thought.


Divorce 
Divorce is the legal annulment of the marriage contract between a man and a woman. It is not a happy occasion and involves feelings of resentment and anger. Without guidance, it is easy to incline to injustice on such an occasion. As such, arbitration, notice period, etc have been detailed in the Quran to be complied with by both the parties. 

[Quran 4:35, Translator:Pickthall]
35 And if ye fear a breach between them twain (the man and wife), appoint an arbiter from his folk and an arbiter from her folk. If they desire amendment Allah will make them of one mind. Lo! Allah is ever Knower, Aware. 


[Quran 4:128-131, Translator:Pickthall]
128 If a woman feareth ill treatment from her husband, or desertion, it is no sin for them twain if they make terms of peace between themselves. Peace is better. But greed hath been made present in the minds (of men). If ye do good and keep from evil, lo! Allah is ever Informed of what ye do.
129 Ye will not be able to deal equally between (your) wives, however much ye wish (to do so). But turn not altogether away (from one), leaving her as in suspense. If ye do good and keep from evil, lo! Allah is ever Forgiving, Merciful.  
130 But if they separate, Allah will compensate each out of His abundance. Allah is ever All-Embracing, All-Knowing. 
131 Unto Allah belongeth whatsoever is in the heavens and whatsoever is in the earth. And We charged those who received the Scripture before you, and (We charge) you, that ye keep your duty toward Allah. And if ye disbelieve, lo! unto Allah belongeth whatsoever is in the heavens and whatsoever is in the earth, and Allah is ever Absolute, Owner of Praise.

[Quran 65, Translator:Pickthall]
1 O Prophet! When ye (men) put away women, put them away for their (legal) period and reckon the period, and keep your duty to Allah, your Lord. Expel them not from their houses nor let them go forth unless they commit open immorality. Such are the limits (imposed by) Allah; and whoso transgresseth Allah's limits, he verily wrongeth his soul. Thou knowest not: it may be that Allah will afterward bring some new thing to pass.  
2 Then, when they have reached their term, take them back in kindness or part from them in kindness, and call to witness two just men among you, and keep your testimony upright for Allah. Whoso believeth in Allah and the Last Day is exhorted to act thus. And whosoever keepeth his duty to Allah, Allah will appoint a way out for him,  
3 And will provide for him from (a quarter) whence he hath no expectation. And whosoever putteth his trust in Allah, He will suffice him. Lo! Allah bringeth His command to pass. Allah hath set a measure for all things.
 4 And for such of your women as despair of menstruation, if ye doubt, their period (of waiting) shall be three months, along with those who have it not. And for those with child, their period shall be till they bring forth their burden. And whosoever keepeth his duty to Allah, He maketh his course easy for him.  
5 That is the commandment of Allah which He revealeth unto you. And whoso keepeth his duty to Allah, He will remit from him his evil deeds and magnify reward for him.
6 Lodge them where ye dwell, according to your wealth, and harass them not so as to straiten life for them. And if they are with child, then spend for them till they bring forth their burden. Then, if they give suck for you, give them their due payment and consult together in kindness; but if ye make difficulties for one another, then let some other woman give suck for him (the father of the child).
 7 Let him who hath abundance spend of his abundance, and he whose provision is measured, let him spend of that which Allah hath given him. Allah asketh naught of any soul save that which He hath given it. Allah will vouchsafe, after hardship, ease.  
8 And how many a community revolted against the ordinance of its Lord and His messengers, and We called it to a stern account and punished it with dire punishment,  
9 So that it tasted the ill-effects of its conduct, and the consequence of its conduct was loss.  
10 Allah hath prepared for them stern punishment; so keep your duty to Allah, O men of understanding! O ye who believe! Now Allah hath sent down unto you a reminder,  
11 A messenger reciting unto you the revelations of Allah made plain, that He may bring forth those who believe and do good works from darkness unto light. And whosoever believeth in Allah and doeth right, He will bring him into Gardens underneath which rivers flow, therein to abide for ever. Allah hath made good provision for him.  
12 Allah it is who hath created seven heavens, and of the earth the like thereof. The commandment cometh down among them slowly, that ye may know that Allah is Able to do all things, and that Allah surroundeth all things in knowledge.


Adultery 
Believers have been commanded to not even come near adultery:
[Quran 17:32 translator: Saheeh International] And do not approach unlawful sexual intercourse. Indeed, it is ever an immorality and is evil as a way. 
[Quran 17:32 translator: Pickthall] And come not near unto adultery. Lo! it is an abomination and an evil way. 


[Quran 4:15-18, Translator:Pickthall] 
15 As for those of your women who are guilty of lewdness, call to witness four of you against them. And if they testify (to the truth of the allegation) then confine them to the houses until death take them or (until) Allah appoint for them a way (through new legislation).
16 And as for the two of you who are guilty thereof, punish them both. And if they repent and improve, then let them be. Lo! Allah is ever relenting, Merciful.
17 Forgiveness is only incumbent on Allah toward those who do evil in ignorance (and) then turn quickly (in repentance) to Allah. These are they toward whom Allah relenteth. Allah is ever Knower, Wise.
18 The forgiveness is not for those who do ill-deeds until, when death attendeth upon one of them, he saith: Lo! I repent now; nor yet for those who die while they are disbelievers. For such We have prepared a painful doom. 

The following ayaat deal with the crime of adultery, the preconditions to prove it in court, the punishment for the crime or the false testimony, and the condemnation of such gossip and slander, particularly the character assassination of innocent persons.   
[Quran 24:1-29 translator: Pickthall]
1 (Here is) a surah which We have revealed and enjoined, and wherein We have revealed plain tokens, that haply ye may take heed.
2 The adulterer and the adulteress, scourge ye each one of them (with) a hundred stripes. And let not pity for the twain withhold you from obedience to Allah, if ye believe in Allah and the Last Day. And let a party of believers witness their punishment.
3 The adulterer shall not marry save an adulteress or an idolatress, and the adulteress none shall marry save an adulterer or an idolater. All that is forbidden unto believers.
4 And those who accuse honourable women but bring not four witnesses, scourge them (with) eighty stripes and never (afterward) accept their testimony - They indeed are evil-doers -
5 Save those who afterward repent and make amends. (For such) lo! Allah is Forgiving, Merciful.
6 As for those who accuse their wives but have no witnesses except themselves; let the testimony of one of them be four testimonies, (swearing) by Allah that he is of those who speak the truth;  
7 And yet a fifth, invoking the curse of Allah on him if he is of those who lie.  
8 And it shall avert the punishment from her if she bear witness before Allah four times that the thing he saith is indeed false,
9 And a fifth (time) that the wrath of Allah be upon her if he speaketh truth.  
10 And had it not been for the grace of Allah and His mercy unto you, and that Allah is Clement, Wise, (ye had been undone).
11 Lo! they who spread the slander are a gang among you. Deem it not a bad thing for you; nay, it is good for you. Unto every man of them (will be paid) that which he hath earned of the sin; and as for him among them who had the greater share therein, his will be an awful doom.
12 Why did not the believers, men and women, when ye heard it, think good of their own own folk, and say: It is a manifest untruth?
13 Why did they not produce four witnesses? Since they produce not witnesses, they verily are liars in the sight of Allah.  
14 Had it not been for the grace of Allah and His mercy unto you in the world and the Hereafter an awful doom had overtaken you for that whereof ye murmured.
15 When ye welcomed it with your tongues, and uttered with your mouths that whereof ye had no knowledge, ye counted it a trifle. In the sight of Allah it is very great.
16 Wherefor, when ye heard it, said ye not: It is not for us to speak of this. Glory be to Thee (O Allah)! This is awful calumny.
17 Allah admonisheth you that ye repeat not the like thereof ever, if ye are (in truth) believers.
18 And He expoundeth unto you the revelations. Allah is Knower, Wise.
19 Lo! those who love that slander should be spread concerning those who believe, theirs will be a painful punishment in the world and the Hereafter. Allah knoweth. Ye know not.
20 Had it not been for the grace of Allah and His mercy unto you, and that Allah is Clement, Merciful, (ye had been undone).
21 O ye who believe! Follow not the footsteps of the devil. Unto whomsoever followeth the footsteps of the devil, lo! he commandeth filthiness and wrong. Had it not been for the grace of Allah and His mercy unto you, not one of you would ever have grown pure. But Allah causeth whom He will to grow. And Allah is Hearer, Knower.  
22 And let not those who possess dignity and ease among you swear not to give to the near of kin and to the needy, and to fugitives for the cause of Allah. Let them forgive and show indulgence. Yearn ye not that Allah may forgive you? Allah is Forgiving, Merciful.
23 Lo! as for those who traduce virtuous, believing women (who are) careless, cursed are they in the world and the Hereafter. Theirs will be an awful doom
24 On the day when their tongues and their hands and their feet testify against them as to what they used to do,
25 On that day Allah will pay them their just due, and they will know that Allah, He is the Manifest Truth.  
26 Vile women are for vile men, and vile men for vile women. Good women are for good men, and good men for good women; such are innocent of that which people say: For them is pardon and a bountiful provision.
27 O ye who believe! Enter not houses other than your own without first announcing your presence and invoking peace upon the folk thereof. That is better for you, that ye may be heedful. 
28 And if ye find no-one therein, still enter not until permission hath been given. And if it be said unto you: Go away again, then go away, for it is purer for you. Allah knoweth what ye do.
29 (It is) no sin for you to enter uninhabited houses wherein is comfort for you. Allah knoweth what ye proclaim and what ye hide.

Stoning to death

Question: Samiya, I beg to differ. The Quran (as well as the Bible) both prescribe STONING TO DEATH as a solution to certain undesirable behaviors. Just follow the links in that article that SHOW you the places in the Quran that prescribe this.
The question is not that scriptures prescribe barbaric behavior, but why do some cultures FOLLOW these barbaric behaviors and others don't. Jews and Christians have scripture support for stoning people to death but we don't hear of them do that any more. Why then do the Muslims still embrace this. And I will add that as this article pointed out we don't hear much or any from Muslims AGAINST this behavior. If there was a public uproar against this type of behavior in the MUSLIM community then I would see a movement toward change, but there is none that I have ever heard of.
My question is WHY? And why, Samiya, do you stick your head in the sand and ignore the fact that the Quran supports this behavior?
Answer: Quran DOES NOT prescribe stoning to death. All the sources quoted are from hadith compilation according to Bukhari. Hadith are historical compilation of oral traditions and stories and are subject to many human limitations. Records in it may be wrong or may be right, each has to be evaluated and cross-checked with the Quran.
Unfortunately, some people still think it is divine law. The reasons are:
-Lack of knowledge of the Quran
-Belief in Hadith books as divine source of guidance
-Illiteracy
-Feudal mindset
There was an era when muslims were highly educated and progressive and Islamic countries were the centre of learning. During those times, much of Europe was in its infamous Dark Ages and many terrible things were done in the name of religion. For various reasons, free thinking and enquiry came to a halt in Muslim countries, and along with sciences and other disciplines, religion also suffered and the door to development of fiqh and sharia work (interpretation of religious edicts to formulate laws consistent with divine guidance and the needs of the time) was also closed.
You, on the outside, find such things reprehensive. Imagine how difficult it is for a muslim to believe in such things and maintain faith. The religion of Islam has suffered much at the hands of those who have misrepresented religion and prevented people from studying and understanding the original texts and taking guidance from it.
As we muslim nations progress and develop our people, it is hoped that more open thought and objectivity will replace the old mindset and thus such practices will be eradited.
What is perhaps central to interfaith discussion is that we evaluate each religion for its merit/demerit based upon its core beliefs and book, rather than take the practices of certain groups and label that as the real religion.

Punishment for Adultery according to Quran

Question: Islam is merciful to men when it comes to adultry, but women they will be stoned to death like old jewish law, havent they heard it takes two to tangle?
Answer: Society is merciful to men as society is largely controlled by men, and laws and rules are bent to favour them. A study of all cultures, be they of whatever religion, throughout history, shows that humans tend to exploit all others whom they can dominate, sadly women being the weaker sex, also thus suffer.
According to the Quran, there is no death sentence for adultery. As for flogging, my understanding from the Quran (see below) is that Allah has indeed made it extremely difficult for anybody to accuse anybody else for adultery. To even admit the case in court you need atleast 4 witnesses, how is it possible to get 4 witnesses for such a thing? Then again, if the accusation is found to be false, the accuser is to be flogged with eighty stripes, and never again is his testimony to be accepted throughout his life! And if a person accuses his/her spouse of adultery, he/she is required to take oath 4 times that the accusation is true, and a fifth oath that if he/she is lying, may the wrath of Allah fall upon him/her.
Given the above conditions, it is indeed extremely difficult, if not impossible to launch such accusations. Also, I don’t see how except the openly promiscuous would suffer such a fate, and then again, after one or two such punishments, how many would be left in society who would dare do such a thing, especially openly?
Surah Noor ayat 1-10
1 A sura which We have sent down and which We have ordained in it have We sent down Clear Signs, in order that ye may receive admonition.
2 The woman and the man guilty of adultery or fornication,- flog each of them with a hundred stripes: Let not compassion move you in their case, in a matter prescribed by Allah, if ye believe in Allah and the Last Day: and let a party of the Believers witness their punishment.
3 Let no man guilty of adultery or fornication marry and but a woman similarly guilty, or an Unbeliever: nor let any but such a man or an Unbeliever marry such a woman: to the Believers such a thing is forbidden.
4 And those who launch a charge against chaste women, and produce not four witnesses (to support their allegations),- flog them with eighty stripes; and reject their evidence ever after: for such men are wicked transgressors;-
5 Unless they repent thereafter and mend (their conduct); for Allah is Oft- Forgiving, Most Merciful.
6 And for those who launch a charge against their spouses, and have (in support) no evidence but their own,- their solitary evidence (can be received) if they bear witness four times (with an oath) by Allah that they are solemnly telling the truth;
7 And the fifth (oath) (should be) that they solemnly invoke the curse of Allah on themselves if they tell a lie.
8 But it would avert the punishment from the wife, if she bears witness four times (with an oath) By Allah, that (her husband) is telling a lie;
9 And the fifth (oath) should be that she solemnly invokes the wrath of Allah on herself if (her accuser) is telling the truth.
10 If it were not for Allah.s grace and mercy on you, and that Allah is Oft- Returning, full of Wisdom,- (Ye would be ruined indeed).

Shariah Law and flogging as a form of punishment

Question: I just want the opinion of all members of the recent implementation of 'Sharia Law' in sawat. Not the forget, the infamous video of flogging a girl.

Answer: We had a brief discussion on ideal Islamic state and shariah law in our Quran class the other day. Our teacher was of the opinion (or so I understood) that there is no such thing as an ideal state, as there always will be something better than an existing state, and thus there can never be a perfect state….. so instead of dreaming of an ‘ideal Islamic state’, we should simply strive, continuously, to improve our current state.As for the Shariah Laws, his opinion was that Allah has provided us with guidance (in the Quran) for only about five things, which as humans we would probably get confused about, and not be able to formulate the correct laws based on our human faculties. The rest, which are known as Islamic Shariah Laws, were formulated much much later, for political reasons.

I think the hudood and zina laws as implemented in Pakistan is simply a mockery of religion, and an additional tool for the oppressors to further their oppression.

Theft and Adultery

Question: The inhumane punishments for theft and adultery with the idea in mind (Tradition by Muslim in Book 1, Number 171) that Allah can forgive anything except worshipping other gods besides Him. If one says that Jesus is the Son of God one goes to hell, but when one commits theft or adultery and only believes in Allah one can go to heaven.

Answer: Theft and Adultery are crimes that affect society…… they must be dealt with firmly. If one repents, Allah is most forgiving, else, one will have to bear the consequences in after-life also.Joining/ascribing partners to Allah is an unforgivable sin if one dies with such belief. If one repents and reverts to the true faith, Allah is Most Beneficent, the Most Merciful

Apostates

Q: The killing of apostates
Most Muslims and non-Muslims think this is an anomaly. They are wrong. This practice is not only in the collective memory of the population in Muslim countries, but all shariah handbooks tell the same story. Everyone who has studied Islam seriously knows that Shariah prescribes the death penalty for apostates. This is based on the authentic traditions of Muhammad who said:"If somebody (a Muslim) discards his religion, kill him." (Bukhari, Book 52, Number 260)and"The blood of a Muslim who confesses that none has the right to be worshipped but Allah and that I am His Apostle, cannot be shed except in three cases: In Qisas for murder, a married person who commits illegal sexual intercourse and the one who reverts from Islam (apostate) and leaves the Muslims." (Bukhari, Book 83 Number 17)In most Islamic countries the death penalty for apostasy is not applied because this is an inhumane law. In these countries however apostates are harassed administratively by all possible means or are punished in one way or another. In the so-called moderate Muslim country Malaysia they have sent a woman to a psychiatric institution and her child has been taken away from her because she had turned away from Islam and became a Hindu. Fortunately she lives in "moderate" Malaysia. If she were living in Saudi-Arabia, she would be beheaded.

A: Capital punishment to the murderer: right
Adultery: Quran only prescribes flogging with a 100 stripes(24:2); and that the adulterer/adulteress cannot marry anybody except another adulteress/adulterer(24:3). How can they be capable of marrying after being killed?
Apostate: There is no compulsion in religion(2:256 )Those who believe, then reject faith, then believe (again) and (again) reject faith, and go on increasing in unbelief,- Allah will not forgive them nor guide them nor guide them on the way.(4:137) How can one believe, reject, and then believe again if one has already been killed?
